Stay on the arrest of Swami Avimukteshwarananda trapped in POCSO case, Allahabad High Court grants anticipatory bail.
Lucknow: Allahabad High Court has granted anticipatory bail to Shankaracharya Swami Avimukteshwaranand Saraswati and his disciple Swami Mukundanand Giri in the case of alleged sexual exploitation of minors. With this decision of the court, the arrest of both has been put on hold. A single bench of Justice Jitendra Kumar Sinha heard the petition and granted this relief keeping in mind the arguments of both the parties.
Hearing on petition and ban on arrest
Swami Avimukteshwaranand Saraswati and Swami Mukundanand Giri had filed anticipatory bail petition in the High Court to avoid arrest. The court had reserved its decision after completion of hearing on the petition.
Even before this, the court had given interim relief and stayed his arrest and had given instructions to avoid any punitive action. Now, after getting anticipatory bail, the danger of immediate arrest of both of them has been averted.

During the hearing, the Additional Advocate General on behalf of the state government opposed the anticipatory bail. He explained the seriousness of the case registered under the POCSO Act and said that the petitioners should have gone to the lower court first.
On the other hand, the defense lawyers argued that the entire case was a conspiracy. The allegations have been distorted and are completely baseless. He said that the truth will come out through an impartial investigation. Swami’s side has termed the matter as a political conspiracy.
The whole matter of Avimukteshwaranand?
This case was registered on the application of Ashutosh Brahmachari. After the order of the district court, an FIR was registered against Swami Avimukteshwaranand Saraswati and his disciple in Jhunsi police station of Prayagraj. In this, allegations of rape of minor children have been made. The case is registered under various sections of the POCSO Act along with sections of the Indian Penal Code (BNS).
Swami Avimukteshwarananda Saraswati has denied the allegations and has promised to cooperate fully in the investigation. He even said that he is ready to conduct narco test if needed. The court has instructed both of them to cooperate in the investigation. This decision has intensified the discussion in religious and legal circles. The investigation is progressing and the final truth is in the hands of the investigating agencies.
