Supreme Court judge’s big comment on the independence of the Election Commission, expressed concern over political interference

Supreme Court of India Judge BV Nagarathna clearly said that institutions like the Election Commission should work with complete independence. He stressed that these institutions should not be affected by any kind of political reaction or pressure. He believes that this is very important for fair elections.

Do the constitutional institutions have the same structure?

The judge said that the structure of institutions like Election Commission, Comptroller and Auditor General and Finance Commission has been kept the same. These institutions have been specifically created so that they can function free from external influences. Their purpose is to maintain impartiality in areas where the normal political process is not sufficient.

Aren’t elections just a process?

Justice Nagarathna said that elections are not just a routine process, but they are the foundation of democracy. It is through these that political power is formed. He said that timely elections are a sign of the strength of democracy and this leads to smooth change of governments.

Can political interference increase the risk?

He warned that if any kind of control is established over the electoral process, it directly affects political competition. This may raise questions on the fairness of democracy. He said that it is important to keep institutions away from political influence.

Has the Supreme Court already given an important decision?

Referring to an old decision, he said that the Supreme Court has already considered the Election Commission as an important constitutional institution. The court had made it clear that the responsibility of the Election Commission is to ensure fair elections. If this institution does not remain independent then the entire process may be affected.

Is there a danger due to weakening of the structure?

Justice Nagarathna said that when the constitutional framework is weak then the threat to democracy increases. If institutions stop monitoring each other, the balance may get disturbed. This affects both transparency and accountability in the governance system.

Is there a need to learn lessons from history?

He said that history teaches that weakening the institutional structure is dangerous for any democracy. If the structure is not strong then protection of rights will not be possible. Therefore, it is important to maintain the independence and strength of institutions.
