Supreme Court reprimands lawyer who sought filing of FIR against PM Modi and Shah
New Delhi. The Supreme Court has reprimanded a lawyer who sought filing of an FIR against Prime Minister Narendra Modi, Home Minister Amit Shah and others over the Citizenship (Amendment) Act, 2019. Justice Joymalya Bagchi, during the hearing in the case on Friday, warned that disagreement with any law or ideology cannot be turned into a criminal offence.
The Court asked, “If Parliament passes an illegal law, is it a crime?” The court made it clear that the solution lies in a constitutional challenge, not in suing lawmakers. When the bench headed by Chief Justice Surya Kant came to know that the said lawyer had been practicing since 1995, it expressed strong displeasure.
Justice Surya Kant said that people trust members of the legal profession, hence such frivolous applications should not be filed. After the court’s comments, the lawyer admitted his mistake and said he did not want to pursue the case further. He pledged that he would not file any similar complaint or petition in relation to his previous complaint given to the police in Alwar.
The court has postponed the fine of Rs 50,000 imposed on him by the Rajasthan High Court after the lawyer expressed remorse and pledged not to take such action in future. The Court also made it clear that if the lawyer violates his undertaking, this penalty order will become effective.
