Supreme Court sent Chhattisgarh’s OBC reservation case to Madhya Pradesh High Court.
In the important constitutional dispute related to OBC Reservation (OBC Reservation Case), the Supreme Court has issued a big order to hear the cases related to the state of Chhattisgarh. Madhya Pradesh Have sent it to the High Court. Earlier, reservation cases related to Madhya Pradesh government were also transferred from the Supreme Court back to the High Court. After the latest order, cases related to both the states will now be heard on a single judicial platform.
According to the information, joint hearing of OBC reservation cases of Madhya Pradesh and Chhattisgarh was going on in the Supreme Court. The court, in a detailed order passed on February 19, clarified that all related matters will be heard further in Madhya Pradesh High Court, Jabalpur. This decision is being considered important in the legal scenario related to reservation policy.
Direction of hearing changed after transfer petition
In fact, the Madhya Pradesh government had earlier transferred all the cases related to OBC reservation from Jabalpur High Court to the Supreme Court. After this, these cases were being heard in the Supreme Court simultaneously with the reservation cases of Chhattisgarh. Now, keeping in mind the administrative and legal convenience, the Supreme Court has decided to send the entire dispute (OBC Reservation Case) back to the High Court level.
Legal experts believe that by holding a detailed factual hearing in the High Court, it will be possible to consider various aspects of the cases in detail, after which, if necessary, the matter can again reach the Supreme Court.
Review petition also filed
According to senior advocate Rameshwar Singh Thakur, after the order of the Supreme Court, a review petition has been filed demanding some amendments. He says that the Special Leave Petitions (SLP) filed in the Supreme Court cannot be sent back directly without canceling the order of the concerned High Court, hence necessary amendments have been demanded in the order.
He said that the court has also returned the special leave petitions, due to which now all the pending cases will be heard in the Madhya Pradesh High Court. This entire incident has given a new legal twist to the reservation dispute (OBC Reservation Case).
Reservation disputes between two states now on one platform
According to experts, the judicial process has been going on for a long time in both the states of Madhya Pradesh and Chhattisgarh regarding the OBC reservation percentage and the constitutional provisions related to it. With this order of the Supreme Court, it will now be possible to hear the cases of both the states in the same legal context.
It is also believed that after the hearing in the High Court, important legal principles related to reservation policy, social justice and constitutional balance may become clear. The eyes of the state governments and the parties related to reservation are now fixed on the upcoming hearing.
The Supreme Court has sent the cases of Chhattisgarh and Madhya Pradesh related to OBC Reservation Case to Madhya Pradesh High Court, Jabalpur. Special leave petitions have also been returned. After the order, now all the cases will be heard at the High Court level, due to which the legal direction of the dispute has changed.
