Supreme Court on Pre-marital Relations: While hearing a case of rape based on false promise of marriage Supreme Court A very important and strict comment is made on pre-marital physical relations. “Before marriage a man and a woman are strangers to each other, so extreme caution should be exercised in such relations,” observed the court.
What exactly is the case?
A 30-year-old woman had accused a man of raping her after luring her into marriage. The accused in this case had applied for bail in the Supreme Court. During the hearing, it was revealed that the victim and the accused met in 2022 through a matrimonial website. The accused had physical relations with her several times in Delhi and Dubai with promises of marriage. However, later the woman realized that the man was already married and had married another woman in January 2024.

Justice B.V. The hearing was held before a bench of Justice Nagaratna and Justice Ujjwal Bhuyan. Commenting on premarital relations, Justice Nagaratna said, “We may be old-fashioned, but before marriage a boy and a girl are complete strangers to each other. No matter how close their relationship is, how can they have physical relations before marriage? We do not understand.”

Don’t have blind faith
The court said in clear terms that no one should place such blind faith in anyone before marriage. A lot of caution is required in such cases. The court also questioned when the complainant woman went to Dubai to meet the accused. “If the woman was really serious about marriage, she should not have made such a journey before marriage,” the court observed.

The victim also claimed that the accused had recorded some personal videos of her without her consent. When she questioned or objected to his marriage, he threatened to broadcast the video. In view of all these factors, the Court has expressed concern over physical abuse and infidelity by promising marriage.
The next hearing by the court is on Wednesday
The court has scheduled the next hearing for Wednesday. The observation comes as cases related to pre-marital affairs and false promises of marriage are frequently brought before the courts. The Supreme Court explained that caution and prudence are required in such relationships, especially when the parties are initially strangers.
