Supreme Court strict on fake arguments prepared by AI, warns lawyers against filing petition without verification
Tezzbuzz Desk – The Supreme Court of India, the country’s highest court, has expressed serious concern over the increasing use of Artificial Intelligence (AI) in court petitions. The court clearly said that use of AI tools without verification can mislead the judicial process.
Outrage over fake quotes
During the hearing of the case, a bench headed by Surya Kant and comprising Joymalya Bagchi and BV Nagarathna commented on the issue.
The bench said that in recent times, there have been instances where lawyers, in petitions prepared with the help of AI, have cited judgments and citations which do not actually exist.
Giving a shocking example, Justice BV Nagarathna pointed out that an alleged decision titled ‘Compassion vs. Humanity’ was cited before the court, which does not exist. He also said that many times such excerpts from actual decisions are presented which are not even recorded in the original decision.
The matter has come up before
The bench said that a similar situation was seen earlier in Dipankar Dutta’s court also. All the previous decisions cited there turned out to be fabricated.
The CJI clarified that the use of technology can be helpful in research and gathering references, but the ultimate responsibility lies with the lawyer. Relying on AI without investigation can become a threat to the judicial process.
