Supreme Court's big decision regarding acquisition of private properties, said- Government cannot take them

New Delhi. A nine-judge bench of the Supreme Court on Tuesday gave a major decision regarding the acquisition of private properties. A bench headed by Chief Justice DY Chandrachud said that every private property cannot be considered part of community property under Article 39(B) of the Constitution.

In a three-part decision, the bench said that private property can be part of the material resources of a community. But it is not necessary that every resource owned by an individual should be a part of the physical resources of the community. With this decision, the Supreme Court overturned the 1978 decision of Justice Krishna Iyer, which had said that all private properties can be acquired by the government.
