Bibhav Kumar in tension even after bail! Delhi Police seeks answers on this matter, hearing today

New Delhi: Where on Monday, 11th November, in the case of attack on AAP MP Swati Maliwal, a sessions court of Tis Hazari has sought reply from accused Vibhav Kumar on the petition of Delhi Police. Delhi Police has challenged the magistrate court's order to file and supply a list of incriminating documents. On this matter, former Delhi Chief Minister Arvind Kejriwal's associate Bibhav Kumar has challenged the order of a city court. This matter will be heard today i.e. on 16th November.

Please note that earlier on November 11, cognizance was taken of the police charge sheet against Kumar for allegedly assaulting Swati Maliwal. Kumar is accused of assaulting Maliwal at the Chief Minister's official residence on May 13 and is currently on bail.

In this regard, the Tis Hazari Magistrate Court had taken cognizance of the chargesheet against Bibhav on July 30. Kumar's lawyer Manish Baidwan had on October 29 filed a review petition in a sessions court in Tis Hazari objecting to taking cognizance of the case under the repealed Code of Criminal Procedure instead of the new Indian Civil Defense Code (BNSS).

The petition said, “Cognizance requires consideration as to whether there are sufficient grounds for taking action under the provisions of the new BNSS, which is lacking in the present case.”

In this petition, discrepancies have been claimed on various grounds including the final report being “erroneous”. “It is important to mention here that crucial evidence such as CCTV footage was obtained and seized during the investigation and a report by FSL is still pending,” it alleges. The petition said that important evidence had not been considered while the court had passed the order for taking cognizance only on the basis of an incomplete charge sheet.

Please note that Bibhav Kumar was arrested by Delhi Police on May 18. He also got bail from the Supreme Court. On this, Delhi Police again filed a charge sheet against him on July 16. This matter is now at the stage of verification of documents. (with agency input)
