The consent trap: Why India’s digital citizens deserve real choice in the AI age | OPINION

India’s digital revolution has empowered hundreds of millions, but it has also quietly normalised one of the largest transfers of personal behavioural data in human history.

In less than two decades, India has transformed into one of the world’s largest digital societies. From UPI and Aadhaar-enabled services to affordable smartphones, social media platforms, cloud ecosystems, and AI applications, digital technologies now underpin communication, commerce, governance, education, entertainment, and even social identity.

Platforms such as Google, Meta Platforms, WhatsApp, YouTube, and Telegram Messenger are no longer merely apps. For millions, they have become essential digital infrastructure.

Yet beneath this remarkable success lies an uncomfortable reality. Most Indian citizens are surrendering vast amounts of personal and behavioural data with limited understanding, little bargaining power, and almost no meaningful choice. The central question confronting India today is no longer whether citizens consent to data collection, but whether that consent is genuinely voluntary at all.

Almost every major digital platform today presents users with lengthy privacy policies and terms of service that must be accepted before access is granted. These documents often permit extensive collection of behavioural data, device information, location history, contacts, browsing patterns, communication metadata, and user interactions across services. Increasingly, they also permit the use of user-generated content and interactions for AI training and algorithmic development.

In theory, this framework is based on informed consent. In practice, it often resembles coerced participation.

Most citizens face a stark binary choice. Accept the platform’s terms in full or lose access to services that have become integral to modern life. Refusing consent may mean losing communication channels, educational groups, professional visibility, commercial reach, or access to digital communities. When digital participation becomes essential for social and economic existence, consent stops being entirely free.

Are they really choices?

Compounding this problem is the widespread use of “dark patterns” through interface designs deliberately crafted to influence user decisions. “Accept All” buttons are typically large, brightly coloured, and immediately visible, while “Reject Non Essential” options are hidden behind multiple layers, presented in confusing language, or sometimes absent altogether. Privacy notices remain dense legal documents that many ordinary users, especially first-generation internet users, cannot realistically comprehend.

The result is a system where compliance is engineered intelligently, rather than consciously chosen. A familiar example is the now ubiquitous cookie consent banner appearing across websites and applications. While presented as a tool for user choice, many such systems are designed in ways that encourage rapid acceptance rather than informed decision-making. “Accept All” options are often immediate and prominent, while rejecting tracking cookies may require navigating multiple menus and settings.

Studies and regulatory investigations in parts of Europe have increasingly questioned whether such consent mechanisms genuinely reflect free and informed user choice.

Most citizens also underestimate the scale of data extraction taking place around them. Privacy risks are often assumed to concern messages, photographs, or personal posts alone. In reality, platforms collect and analyse a far broader spectrum of information, from browsing habits, search history, device identifiers, purchase behaviour, social networks, location patterns, engagement duration, voice inputs, and facial imagery to communication metadata.

Even platforms claiming end-to-end encryption continue to generate enormous volumes of metadata. Data about behaviour rather than message content. Such metadata can reveal intimate details about relationships, routines, affiliations, movement patterns, and social structures. This is easily achievable in today’s AI-enabled ecosystem.

This data powers the modern digital economy. It fuels precision-targeted advertising, behavioural profiling, predictive analytics, recommendation engines, and increasingly, generative AI systems, trained on user interactions, prompts, images, and voice samples. Citizens are no longer merely consumers of digital platforms. They have effectively become the raw material powering AI-era business models. The emerging challenge is no longer just data collection. It is inferential privacy.

Modern AI systems can derive highly sensitive conclusions from seemingly ordinary behavioural data. Platforms may infer emotional states, political preferences, purchasing capacity, social vulnerabilities, psychological tendencies, or persuasion patterns, without users ever explicitly disclosing such information. Unlike traditional databases, AI systems continuously learn, correlate, and predict. Current consent frameworks designed for conventional data processing may prove inadequate for this new AI-driven ecosystem.

India has taken important steps to address these concerns. The Digital Personal Data Protection Act, 2023 and subsequent rules establish a framework based on consent, purpose limitation, data minimisation, and user rights, ensuring that the privacy of citizens is their fundamental right.

These developments are significant and necessary. But substantial challenges remain.

A large percentage of citizens remain unaware of their rights. Enforcement capacity is still evolving. Regulators often lack the technical resources and institutional scale available to global technology platforms. In many cases, compliance risks become a checkbox exercise, centred around uploading policies rather than ensuring meaningful user protection.

The asymmetry is glaring. Individual citizens bear the burden of navigating complex consent systems, with limited understanding, while platforms designing the ecosystems face relatively limited immediate accountability. Jurisdictional challenges further complicate enforcement, particularly when globally influential platforms operate with limited local accountability structures.

This imbalance is becoming even more significant as AI systems integrate deeply into daily life. AI platforms are no longer passive storage systems. They increasingly function as behavioural ecosystems capable of shaping attention, influencing perception, curating information exposure, and generating synthetic content at scale.

Unchecked data practices in such an environment carry consequences far beyond advertising. They can influence democratic discourse through micro-targeting, amplify algorithmic bias, manipulate consumer behaviour, create surveillance vulnerabilities, and deepen societal polarisation. As India advances toward AI-enabled governance, smart cities, digital public infrastructure, and automated service delivery, questions of data sovereignty and platform accountability become central to democratic resilience itself.

India, therefore, faces a critical strategic challenge as to how to remain a global digital leader without reducing its citizens to perpetual sources of easily accessible and extractable behavioural data. The solution is not to slow innovation. Nor is it to pursue excessive state control over the digital ecosystem. India’s objective should instead be to build a trustworthy digital framework grounded in transparency, accountability, and genuine user agency.

Several reforms deserve urgent attention

First, India must move toward genuine consent mechanisms. Citizens should be able to reject non-essential tracking or AI training without losing access to core services. Privacy notices must become concise, understandable, multilingual, and accessible to ordinary users. “Reject Non-Essential” options should be as prominent and simple as “Accept All” choices.

Second, platform accountability must evolve significantly in the AI era. Large Data Fiduciaries should face higher obligations regarding transparency, AI training disclosures, data retention practices, inferential profiling, and algorithmic accountability. Citizens should have simpler mechanisms to access, correct, erase, or restrict the use of their personal data.

Third, enforcement capability requires substantial strengthening. Meaningful regulation cannot rely solely on uploaded privacy policies or reactive complaint systems. Regulators will increasingly require technical capability to audit algorithms, AI training pipelines, metadata practices, and behavioural targeting mechanisms. Fast-track grievance redressal and stronger jurisdictional enforcement mechanisms are equally essential.

Fourth, India must invest seriously in digital literacy. Privacy awareness should become part of educational curricula and public digital education campaigns. Citizens cannot exercise meaningful rights if they do not understand how digital ecosystems function.

Finally, India should encourage greater technological diversity and privacy by design innovation. Excessive dependence on a handful of dominant global platforms creates long-term strategic vulnerabilities. Supporting open standards, indigenous innovation, and privacy-conscious alternatives can strengthen both digital resilience and user choice. India’s growing technology ecosystem also presents opportunities for indigenous and privacy-conscious alternatives to evolve further.

In fact, India today has the scale, talent, and ambition to lead the world in responsible digital transformation. But the success of that transformation cannot be measured solely by the number of users online or the volume of data generated. In the AI age, the true test of a digital democracy will be whether its citizens can participate in the digital ecosystem as informed, empowered individuals. And not merely as invisible data sources powering systems they neither understand nor control.

The question is no longer whether Indians will live digitally. That future has already arrived.

The real question is whether India can build a digital future where innovation and individual dignity coexist. And where consent once again becomes a genuine expression of choice, rather than the unavoidable cost of modern life.
