Ranchi: Jharkhand High Court, while giving an important verdict in a matrimonial dispute case, has said that keeping private and objectionable photographs of the wife by the husband without her permission and threatening to make them public comes in the category of cruelty. The court has considered this as a serious attempt to assassinate the character of the woman.

The case is from Jharia in Dhanbad, where a couple got married in the year 2020. The wife alleged that the next day after the marriage, while she was sleeping, the husband checked her mobile without asking. There were some old personal photographs of the wife in the digital account of the mobile. Which the husband secretly transferred to his phone. After this the husband started torturing her mentally through those pictures. He showed those pictures to his family members and mentally abused his wife by threatening to post them on social media.

Hearing the case, a division bench of Justice Sujit Narayan Prasad and Justice Arun Kumar Rai said that having unauthorized access to photographs of someone’s personal life and using them to intimidate is mental cruelty. A husband tarnishing the image of his own wife and humiliating her in front of the family causes unbearable pain. Earlier, the family court had rejected the wife’s divorce petition. Which has now been canceled by the High Court. The court held that under the Hindu Marriage Act, cruelty is not only physical, but hurting someone’s reputation is also a solid ground of mental cruelty. The court ruled in favor of the wife and considered it a valid ground for divorce.
