A businessman from Korba had an accident.

The entire incident took place on 23 April 2023. Businessman Amit Aggarwal, resident of Korba district, was coming to Korba from Raipur in his brother’s Innova car. During this time, while reaching near Tarda village, while trying to save the vehicle coming from the front, the car overturned and collided with a tree. Amit Aggarwal was seriously injured in this accident. Rs 36 lakh was spent on the treatment.

Car’s airbag did not open

When this accident happened, not a single airbag of the car opened, due to which Amit Agarwal got seriously injured. After this accident, Amit Agarwal’s brother Sumit Agarwal had complained about the whole matter in the Consumer Commission against the car manufacturing company.

District Commission gave unilateral decision

During the hearing in this matter, no one from the company side participated, due to which the District Commission took unilateral action and ordered to pay Rs 36.53 lakh for a new vehicle or the amount spent on treatment.

Toyota Company had appealed against this order in Chhattisgarh State Consumer Commission, Bilaspur. During the hearing of the case, Chhattisgarh State Consumer Commission rejected the arguments of Toyota Company. At the same time, based on the surveyor’s report, the damage caused to the car and Amit Aggarwal, it was believed that despite the serious damage caused to the consumer, the fact that not a single airbag of the car deployed proves the manufacturing defect in the car. In such a situation, the Commission gave an important decision that the complainant had bought an expensive car for his safety, but the airbag did not open at the time of need. In such a situation, selling a low quality vehicle will be considered as deficiency in service. Besides, the company has been ordered to give Rs 61 lakh 36 thousand to the consumer.
