Rao, on the legal opinion sought by Reliance Jio, said that in the present facts the issue of level playing field with terrestrial access services has been completely sidelined in the consultation letter issued by TRAI. This resulted in stakeholders being deprived of the opportunity to provide comments and the opportunity to engage in consultation before making recommendations, as specifically requested by DoT.

Gross breach of transparency obligations

He said that by not inviting comments on the aspect of level playing field with terrestrial access services, TRAI is in gross violation of its transparency obligations under the TRAI Act. The company had earlier written to TRAI Chairman Anil Kumar Lahoti to amend the consultation letter to recommend terms and conditions for spectrum allocation for certain satellite-based commercial communication services, but the regulator rejected the company's request.
