New Delhi, 29 December. The Supreme Court on Monday stayed the Delhi High Court order suspending the life sentence of expelled Bharatiya Janata Party (BJP) leader Kuldeep Singh Sengar in the 2017 Unnao rape case. Chief Justice Surya Kant, Justice J.K. A vacation bench of Justice Maheshwari and Justice Augustine George Masih issued notice to Sengar seeking his reply on the CBI’s petition challenging the High Court order.
Solicitor General Tushar Mehta, appearing for CBI, urged the bench to stay the High Court order. The bench said it would look into the matter. It said that Sengar will not be released from custody on the High Court’s December 23 order. The bench said that there are many important questions of law to be considered in this case and adjourned the hearing of the case after four weeks.
The High Court had suspended the sentence of Sengar, who is serving life imprisonment in the Unnao rape case, saying he had already spent seven years and five months in jail. The high court had suspended Sengar’s sentence pending an appeal challenging his conviction and sentence in the rape case.
Sengar has challenged the December 2019 decision of the lower court in this case. However, the expelled BJP leader will remain in jail as he is serving a 10-year sentence in the custodial death case of the victim’s father and he has not been granted bail in that case. The rape case and other related matters were transferred from a lower court in Uttar Pradesh to Delhi on the directions of the Supreme Court in August 2019.
