What argument did CBI give?
Solicitor General Tushar Mehta, appearing for the CBI, said that the case was very serious, in which a minor girl was gruesomely raped, and the High Court did not pay adequate attention to Section 376 of the IPC and Section 5 of the POCSO. Responding to this, Justice JK Maheshwari said that Section 376 has already been considered.
The case is related to a minor victim
SG Tushar Mehta further said that the High Court had not taken into account several important aspects, especially that the case concerned a minor victim. He also said that Sengar has been convicted in two cases, and the victim was below 16 years of age at the time of the incident. She was 15 years 10 months old. This conviction is still pending on appeal. SG Mehta said the reason for conviction was clear as the rape was committed by a public servant, and the CBI proved it with facts and evidence.
