Big decision of American courts: Indians in custody got relief, orders for bond and release
Relief For Detained Indian Nationals: This week, the courts of various states of America have given a new hope to the Indian citizens kept in immigration detention by giving important decisions in favor of them. Under these decisions, many Indians imprisoned in states like California, Michigan and New York have got the right to be released on bond or re-heard. The judges acknowledged that immigration officials had not properly followed legal procedures while detaining these people. Wave of relief in California and Michigan
The San Diego court, while ruling on Harbit Singh’s petition, has ordered a bond hearing within seven days to review his custody. The judge made it clear that keeping someone in prison for a long time without any solid basis is a flagrant violation of the legal process and is not justified. Sagar Ram has also got relief in Michigan where the court rejected the government’s claim that he should be kept in compulsory custody.
Court strictness in New York and Oklahoma
In the case of Harmanpreet Singh, the Brooklyn Court of New York directed the government to present concrete evidence whether he is a threat to the community or not. The judge commented that detaining someone without proper security measures violates the Fifth Amendment to the US Constitution, which protects civil rights. Similarly, considering the custody of Karandeep Singh in Oklahoma as eligible for bond, the court has issued an order to hear him immediately.

Immediate release and some petitions rejected
In California, the court ordered the immediate release of Bhawandeep Singh Dhaliwal and barred authorities from arresting him again without legal process. At the same time, Vikrant Singh has also got immediate freedom under the conditions of his previous release, which is a matter of great happiness for him and his close ones. However, the petitions of some prisoners like Gurpreet Walia Singh were also rejected because the court found their detention justified as per the law.
