Website should be used to provide information
Guidance from the equalities watchdog says it ‘would not be practical or appropriate’ to challenge people in places like supermarkets or cinemas to use the gents or ladies toilet. It says signs and websites should be used to tell people that a service is single-gender. People may be asked if they are eligible to use it if there is ‘clear evidence’ that men are trying to access women-only spaces.
There is a flaw in the guidance
It is being told that the new code of practice of the Equality and Human Rights Commission, which has been updated after the historic decision of the Supreme Court on single-sex places. It also warns that ‘it is not always possible to determine a person’s gender based on their appearance. Any official document like passport or driving license does not provide ‘reliable evidence’.
Maya Forstetter, chief executive of Gender Matters, a women’s rights charity, welcomed the publication of the document, but added that the guidance could be clearer on whether service providers are entitled to ask people about their gender and seek honest answers.
Asking gender would not be practical
It is strange to say that it would not be ‘practical or correct’ to ask a person about their gender about facilities like toilets. On the contrary, if a man steps into a woman’s shoes, it would not only be right but also necessary to challenge him. Otherwise women’s rights cannot be implemented in single places.
