“What were you doing in Delhi?” HC’s strict comment in CM Rekha Gupta case, refusal to stay trial
Delhi High Court has refused to give major relief to the accused in the case of alleged attack on CM Rekha Gupta in August last year. The court rejected the demand to stay the trial court proceedings. This decision was given by Justice Anup Jairam Bhambhani. In the case, a petition to stay the trial was filed by the accused Sakaria Rajeshbhai Khimjibhai and Tehseen Raza, which was not accepted by the court. After this decision, the hearing of the case will continue in the trial court.
The case was heard in the court of Justice Anup Jairam Bhambhani, where the petition of the accused was rejected. A demand to stay the trial was made by the accused Sakaria Rajeshbhai Khimjibhai and Tahseen Raza, which was not accepted by the court. According to the lawyer, the next hearing of the case is to be held on April 20, when the evidence will start being presented. The trial court has already summoned the Medical Chief, the doctor who prepared the MLC and the Personal Security Officer (PSO) of Rekha Gupta for testimony.
What were you doing in Delhi?
During the hearing, Justice Anup Jairam Bhambhani said that the court does not stay any action unless it is clear that it will lead to some wrong or untoward situation. The court said that at present it does not see any such basis. Along with this, the court raised questions on the presence of accused Sakaria Rajeshbhai Khimjibhai and Tehseen Raza and asked that when both are not residents of Delhi then why were they present in the “public hearing” of the Chief Minister.
Further hearing will be held on May 21
During the hearing, the court also said that generally people like taxi or auto drivers work every day for their livelihood and do not leave their work to join some activity or protest hundreds of kilometers away. The court raised questions on the circumstances of the accused in this context. The court has refused to stay the trial in the case for the time being and has fixed May 21 as the date of further hearing.
CM was attacked last year
This hearing in the Delhi High Court was related to the petition in which accused Sakaria Rajeshbhai Khimjibhai and Tehseen Raza had challenged the trial court’s order framing charges against them. The case pertains to the alleged attack on Rekha Gupta, which took place during a public hearing held at her Civil Lines Camp office on August 20, 2025. In this case, the trial court had framed serious sections against the accused in December last year, which include attempt to murder, criminal conspiracy and attack on a government servant.
Forensic investigation will be done on the mobile phones of the accused.
After the hearing, Justice Anup Jairam Bhambhani has directed the Forensic Science Laboratory (FSL) based in Rohini to examine the mobile phones of the two accused Sakaria Rajeshbhai Khimjibhai and Tehseen Raza and submit its report to the court within four weeks. The court made it clear that it wanted to find out whether there was any mutual relationship or contact between the two accused. During the hearing, Justice Bhambhani said that one of the accused is not a resident of Delhi and the other was involved in the public hearing, so it is important to understand whether there is any connection between them or not. The court also remarked that the contents of the mobile phone could be crucial in the investigation of the case, hence a thorough examination of the digital evidence is necessary.
