Supreme Court decision
The Supreme Court ruled by a 6-3 majority that the power to levy taxes or tariffs rests originally with Congress under the Constitution, unless that power is explicitly delegated to the President. Chief Justice John Roberts wrote the majority decision. Justices Neil Gorsuch, Amy Coney Barrett, Sonia Sotomayor, Elena Kagan and Ketanji Brown Jackson agreed with him.
Justices Clarence Thomas, Samuel Alito and Brett Kavanaugh dissented. The court made it clear in its decision that the powers of the President may be extensive, but they are not above the Constitution. If the tariff is viewed as a tax, Congress would have the authority to enact it.
