Bihar CM Nitish Kumar can resign from the membership of the Legislative Council today. Along with this, Bharatiya Janata Party’s National President Nitin Naveen will also resign from the membership of Bihar Assembly today. He has also been a member of the Legislative Assembly continuously since 2006. Both have won the Rajya Sabha elections, so now they will have to resign from their posts in the Bihar Legislature.
According to reports, Chief Minister Nitish Kumar will submit his resignation to Legislative Council Chairman Awadhesh Narayan Singh and Nitin Naveen will submit his resignation to Speaker Prem Kumar. According to the constitutional rule, after being elected to the Rajya Sabha, he has to give up the membership of the previous House within 14 days. In such a situation, today is the deadline for Nitish Kumar and Nitin Naveen.

What did JDU leaders say?
Many leaders of Nitish Kumar’s party are not happy with his decision. Even during his visit, the workers are continuously appealing to him not to leave Bihar. In such a situation, there was discussion in the political circles whether Nitish Kumar will go to Delhi or will play some other game at the last moment. However, it has been made clear by his party that Nitish Kumar is going to resign from Bihar Legislature today. Party leader Ananth Kumar Singh said on Sunday that party workers were against his decision but the CM had already made up his mind.
Will he remain CM even after resignation?
Nitish Kumar may have decided to go from Bihar to Delhi but he has not yet resigned from the post of CM. The party has not yet shared any information regarding when he will resign from the post of CM. Bihar Assembly Speaker Dr. Prem Kumar has made it clear that if Nitish Kumar wants, he can remain on the post of Chief Minister for the next 6 months. According to the rules, while being a member of one House, a member has to resign from one House within 14 days of being elected to the other House. Under this rule, Nitish Kumar and Nitin Naveen will have to resign from one house today.
The Assembly Speaker said that under Article 164 (4) of the Constitution, any person who is not a member of either of the two houses can also hold the post of Minister or Chief Minister for 6 months. In such a situation, Nitish Kumar can remain the Chief Minister till September 2026 despite resigning from the post of Bihar Legislature. However, if he wants to remain CM for more than 6 months, he will have to become a member of any house of Bihar Legislature.

Experts believe that Nitish Kumar will not resign from the post of CM today. Now the final decision will be taken regarding the formation of the new government and after that Nitish Kumar will be bid farewell to Bihar. Political experts believe that Nitish Kumar may resign from his post after the assembly elections being held in 5 states.
