New Delhi. Many builders are accused of making big promises in the brochures and websites at the time of starting their projects, but do not fulfill them later. In one such case, the Supreme Court has reprimanded the big builder of Delhi-NCR, DLF Home Developers, saying that the promises made in the brochure are not just marketing, the project will have to be given to the customer as per the promises made in the brochure. Justice Ahsanuddin Amanullah and Justice R. Mahadevan's bench said that the promises made by builders to customers cannot be ignored as mere marketing tactics.
While hearing the case of 'The Primus' project of DLF Home Developers, the court expressed displeasure over the changes in the proposed 24 meter wide road. The Supreme Court bench said that it is the responsibility of the real estate developer to deliver the residential project he is preparing to the buyers as per the promises made. The court said that the layout and other promises made in the brochure of the residential project cannot be considered to attract customers. The builder will have to develop the project in the same manner as told to the customers.
The Supreme Court bench said that the change in the width of the road is not trivial. This matters. The Supreme Court warned the builder that if steps were not taken as per the promises made in the brochure by the next hearing, appropriate orders would be passed. The Supreme Court was told that in the project, out of the 147 meter long portion of the 24 meter wide road, 52 meter has been made green area. A large part of the road is also being used for parking the vehicles of society people and guests. The bench was displeased that the builder did not rectify the deficiency even after giving several chances. The court said that it is beyond comprehension that the situation has not changed till now. In this case, the Supreme Court had asked CBI to investigate. CBI had given the status report. The Supreme Court also expressed displeasure at the Haryana government and officers for not providing the necessary land for the road.
