Prayagraj. Allahabad High Court has canceled the special court's order to impose SC/ST Act on 22 policemen posted at Ghughuli police station in Maharajganj district. Justice Santosh Rai of Allahabad High Court said that if an allegation is made against a government employee while on duty, a careful investigation is necessary before ordering the registration of an FIR. The court said that this process cannot be turned into a mini trial.

The Allahabad High Court, which has accepted the criminal appeal of Ghughuli Police Station Inspector Rakesh Kumar Yadav, has directed all the judicial officers of UP to consider the police's stand and the legal procedure before giving the order to register an FIR. The Allahabad High Court also ordered the District and Sessions Judges to monitor the implementation of its instructions in the monthly meetings. A copy of the decision has also been sent to all judicial officers, JTRI, DM, all SSPs, SPs and Police Commissioners. Allahabad High Court found during the hearing that the judge of the special court did not explain in the order why investigation was not necessary in this case. The police report was also not considered. The Allahabad High Court considered the arrest and GD entry as an indication of prima facie nexus between the presence and duty of the policemen.

Two women of Basantpur village of Maharajganj had alleged that on the night of June 6, 2026, about 20 people along with Inspector Rakesh Kumar Yadav and Constable Amit Kumar entered their house without a warrant to search. There was no female police with them. The women alleged that the policemen misbehaved with them, stopped them from going to the toilet and used caste based abuses. The women said that even after complaining to the SP on June 12, when no action was taken, they filed an application in the special court regarding SC/ST Act. On this, on August 11, an order was given to file a case against 22 policemen under SC/ST Act. In their appeal, the policemen argued that they were fulfilling government responsibilities. Two conflicting cases related to the incident were already registered. In which charge sheet has been filed. In such a situation, the new complaint against the policemen was a retaliatory action.
