Pawan Kheda did not get anticipatory bail, decision of Gauhati High Court

The demand for anticipatory bail of Congress leader Pawan Kheda in the case of making fabricated allegations of defamation against the wife of the Chief Minister of Assam was rejected. Gauhati High Court rejected his petition on Friday (April 24). This case is related to the FIR lodged by Riniki Bhuyan Sarma, wife of Chief Minister Himanta Biswa Sarma. In this, Pawan Kheda is accused of making false allegations against him related to holding multiple passports and foreign assets.

Before this decision of the High Court, the Supreme Court had also refused to interfere in this matter. In such a situation, there is a possibility of Pawan Kheda surrendering and applying for regular bail. Earlier on April 10, the Telangana High Court had granted him one week’s anticipatory bail. However, Assam Police challenged this order in the Supreme Court, after which the top court stayed this relief.

On April 17, the Supreme Court not only refused to lift the stay, but also rejected Pawan Kheda’s demand for extending the interim relief, so that he could get an opportunity to approach the Gauhati High Court.

The controversy started when Pawan Kheda, ahead of the Assam Assembly elections, alleged that Riniki Bhuyan Sarma held multiple passports from countries like UAE, Egypt and Antigua-Barbuda. He also claimed that he acquired foreign citizenship between 2021-22 and the Chief Minister did not disclose his foreign assets in his election affidavit. The investigation revealed that these allegations were baseless and misleading.

These allegations were dismissed by Himanta Biswa Sarma and his wife as “fabricated” and “AI-generated lies”. He also said that these claims were made by copying the passport of a Pakistani citizen and were spread with the aim of misleading voters.

After this, Riniki Bhuyan Sarma filed criminal and civil defamation cases against Pawan Kheda. There is intense debate in political circles regarding the matter, while the legal process is going on and further action will be decided in the court.
