Judge Who Argued With Lawyer At Rohini Court Transferred Sent To Judicial Academy

The matter became a major administrative issue after the video of the face-to-face fight between the District Judge and lawyers in Delhi’s Rohini court went viral. Amidst the viral video and growing protests, Delhi High Court has removed Rohini Court District Judge Rakesh Kumar from regular judicial work with immediate effect. The High Court has attached him to the Delhi Judicial Academy, where he will currently be involved in training or administrative work.

This whole controversy started on Saturday (May 16) during the hearing in Court No. 212 of Rohini Court. According to the information, Advocate Rajeev Tahlan, President of Rohini Court Bar Association, had requested for hearing in a case after normal passover i.e. after some time. Meanwhile, the judge refused to do so, due to which the atmosphere in the court suddenly became heated and the debate turned into a heated argument.

It is alleged that Judge Rakesh Kumar used objectionable and aggressive language during his conversation with the lawyers. According to the viral video and eyewitnesses, the judge can be heard saying, “Do whatever you want”, “Are your fathers and grandfathers sitting in the High Court and the Supreme Court?” The lawyers also allege that the judge used abusive words against the legal fraternity, in which the judge used derogatory words like ‘chutiya’ for the lawyer.

On the other hand, some lawyers present in the court also reacted sharply against the judge. In the viral video, some advocates are seen accusing the judge of drinking alcohol instead of working in his chamber. Some even called him a “junkie.” The situation became so tense that the court staff had to intervene so that the matter did not escalate into a physical clash.

After the incident, the Coordination Committee of all the District Court Bar Associations of Delhi issued a strong statement. The committee described the judge’s behavior as highly objectionable and said that it is against the dignity of the entire lawyer community and the judicial system. The committee demanded an impartial investigation and strict disciplinary action from the High Court.

“After due consideration, the Coordination Committee decided that DJ-04 Shri Rakesh Kumar-V, North-West District, Rohini Courts should be immediately transferred from Rohini Courts, all court work should be taken over from him immediately and an investigation into his conduct should be initiated at the earliest,” the committee said in its resolution.

Many senior advocates and bar leaders termed the incident as an attack on the independence of the bar and demanded judicial accountability. As the protests escalated, there were fears of work being halted in the district courts of Delhi. However, the possible boycott was averted after the prompt action of the High Court.

According to the order issued by Delhi High Court, now District Judge Dheeraj Mittal will take charge in place of Rakesh Kumar in Rohini Court. However, till now the High Court has not announced any formal investigation into this entire controversy.
