West Bengal SIR: SC made a big intervention by using Article 142, in whose name they have the right to vote in the tribunal, Mamta said – I am proud of the judiciary
New Delhi. The Supreme Court has used Article 142 of the Constitution in the West Bengal SIR case to protect the voting rights of citizens ahead of the upcoming elections. Amid over 34 lakh appeals pending against deletion of names and objections from the voter list, the Supreme Court has set clear timelines to ensure that no eligible voter is deprived of his democratic right.

According to the order of the Supreme Court, for the first phase of voting to be held in West Bengal on April 23, those persons whose appeals will be decided by 19 Special Appellate Tribunals by April 21, will be eligible to vote. Similarly, those whose appeal will be decided by the Appellate Tribunal by April 27, will be able to vote in the second phase to be held on April 29. The Supreme Court has directed the Election Commission to release supplementary voter list for such people. According to this, where the Appellate Tribunal decides on the appeal of the people by April 21, a supplementary voter list in their names should be released. All those whose names will be in this voter list will be eligible to vote in the first phase on 23 April. Similarly, a supplementary voter list will also be released containing the names of those whose names will be decided by April 27, who will be eligible to vote in the second phase on April 29.
The Supreme Court said that if any appeal gets a clean chit from the tribunal, then this order will be effective in West Bengal considering the concerned voter as eligible. The court said that voting is not only a constitutional but also an emotional right. With this decision, an attempt has been made to maintain transparency in the election process.

Mamata Banerjee has welcomed this decision of the Supreme Court. She said that I was asking everyone to be patient. If not today then tomorrow everyone’s name will finally come. Today the Supreme Court has issued the order. The tribunal will take a decision on the applications of those who filed the appeal by 21st and the supplementary voter list will be published before the first phase of voting on 23rd April. The same procedure will be followed for the second phase of voting on 29th. I urge all concerned to ensure that the voter list is sent by the same night. I am happy. I am proud of the judiciary. I had filed this case, the decision is based on my petition. No one is happier than me today.
