New Delhi. Justice Subhash Vidyarthi of Lucknow Bench of Allahabad High Court, who is hearing the ongoing dual citizenship case against Rahul Gandhi, has recused himself from the case. Justice Subhash Vidyarthi had earlier ordered registration of FIR against Rahul Gandhi, later modified his order and issued a notice to Rahul Gandhi asking him to hear his side. Regarding this, petitioner BJP leader Vignesh Shishir had made separate posts on social media questioning the decision of Justice Vidyarthi. Justice Subhash Vidyarthi, objecting to these social media posts of the petitioner, recused himself from hearing the case.

Justice Subhash Vidyarthi today mentioned the comments made by the petitioner on social media as soon as the hearing of this case started. He asked whether it is right to throw mud on the bench? Justice Vidyarthi also said that the petitioner used the court for his political gains. Although an attempt was made by the petitioner to clarify this matter, Justice Vidyarthi refused to listen. Justice Vidyarthi said that I am hurt by the comments made on social media, hence I am sending the file of this case to the Chief Justice of the High Court so that a new bench can be formed to hear the case.

Let us tell you that on April 17, Justice Subhash Vidyarthi had ordered to register an FIR against Rahul Gandhi, but before signing the order, he took cognizance of a decision of the full bench of the High Court, Jagannath Verma Vs State of UP (2014). It has been said in this decision that if the case comes under the scope of revision, then it is necessary to issue a notice to the potential accused and give his side an opportunity of being heard. In view of this order, Justice Vidyarthi changed his earlier order and said that in view of this legal situation, it would not be appropriate to pass the order without giving notice.
