Supreme Court On Mamata Banerjee: ‘She endangered democracy by using the system’, Supreme Court reprimands CM Mamata Banerjee before the first round of elections in West Bengal.
New Delhi. Voting is to be held on 152 seats in the first round of assembly elections in West Bengal on Thursday. Earlier on Wednesday, the Supreme Court made a strong comment by reprimanding West Bengal CM Mamata Banerjee for reaching there and taking away some documents during the I-PAC raid. While hearing the petition filed by ED demanding CBI investigation in this case, the bench of Supreme Court Justice Prashant Kumar Mishra and Justice NV Anjaria said that this in itself is the work of a person who incidentally is also the CM. The Supreme Court strongly remarked that he had put democracy in danger by using the entire system.

The Supreme Court made it clear that the CM of any state cannot enter any place like this in the middle of the investigation. The Supreme Court said that when a CM interferes in the ongoing investigation by a central agency, it cannot be called a fight between the central and state governments. West Bengal government lawyer and TMC MP Maneka Guruswamy raised questions on the admissibility of the writ petition filed by the ED under Article 32 of the Constitution. He said that this is a dispute between the Center and the state. Therefore, instead of Article 32, there should be a case under Article 131. On this, Justice Prashant Kumar Mishra asked what right does the state have in this? He said that this is not a dispute between the Center and the State, you cannot interfere in such a situation. The court said that the CM of the state intervenes in the investigation and you are saying that this is a dispute between the Center and the state?

The Supreme Court bench said in a strong tone that you put democracy in danger and then argue that this is a dispute between the Center and the State. The Supreme Court said that you cited the Kesavananda Bharti and Seervai cases, but at that time no one would have imagined such a situation that such a day would come in this country when a sitting CM would just walk into the office of some other agency. Solicitor General Tushar Mehta told the bench that the West Bengal CM removed some objectionable material during the ED action. In the petition, ED has demanded a CBI inquiry against Mamata Banerjee and West Bengal police officers, accusing them of creating obstruction during the IPAC raid. Besides, ED has also challenged the FIR lodged against it by West Bengal Police.
