Supreme Court On Abortion: ‘The time limit for abortion should be increased by changing the law’, know why the Supreme Court said this to the Center
New Delhi. The Supreme Court, during the hearing of an abortion case on Thursday, told the Central Government that it should consider amending the law. So that women who are victims of rape can get permission for abortion even after more than 20 weeks. In this case, the rape victim is a 15-year-old minor and during the hearing on the approval for termination of her 30-week pregnancy, the Supreme Court asked the Center to consider changing the law.

The bench of CJI Surya Kant and Justice Jaimalya Bagchi said that when pregnancy occurred due to rape, there should be no time limit for abortion. The court said that the law may be changed according to time. The court said that if the girl is not given permission for abortion, she will have to face mental trauma throughout her life. The Supreme Court bench said that if there is no permanent physical harm to the mother, abortion should be performed. The court asked Delhi AIIMS to advise the girl’s parents on this issue. Because the final decision should be that of the child and her family.

The court said that many children are already up for adoption. Many children live destitute on the streets and mafias involved in child trafficking are also active. The court said that the 15 year old girl had an unwanted pregnancy. She has to study, but we are forcing her to become a mother. The court said that imagine how much pain and humiliation he has suffered. Earlier, Solicitor General Tushar Mehta, on behalf of AIIMS, told the court that the 30 week old fetus has become a living baby and abortion is not possible in this condition. He also said that the minor had serious deformities and health problems. On this, the Supreme Court bench said that the decision on abortion will depend on the wishes of the girl and her parents. The court has also urged the media to be sensitive in reporting this case and not to record everything said in the hearing.
