Excise Policy Case: Hearing on CBI’s petition postponed, Justice Swarnkanta Sharma did not reach the court.

The petition of the Central Bureau of Investigation (CBI) in the case related to Delhi’s excise policy could not be heard on Monday, in which the decision to acquit Chief Minister Arvind Kejriwal and other accused was challenged. The hearing of the case was scheduled at 2:30 pm on Monday, but the court proceedings could not start on time. According to the information, Justice Swarnakanta Sharma, who was hearing the case, was not present in the court that day, due to which the hearing was postponed. Because of this, no debate could take place on the petition of the Central Bureau of Investigation. Now the date of next hearing in this case is awaited, in which the petition challenging the decision of acquittal will be considered further.

Justice Swarnakanta Sharma had on April 20 rejected the petition in which Chief Minister Arvind Kejriwal and former Deputy Chief Minister Manish Sisodia had sought his recuse from the case. Following this, a letter was written to the judge on behalf of both the leaders, stating that they would no longer appear before him personally or through a lawyer and would follow “Mahatma Gandhi’s path of Satyagraha”. A similar letter was also sent to the judge by former Aam Aadmi Party MLA Durgesh Pathak.

During the last hearing, Justice Swarnakanta Sharma had remarked that the court had not yet received all the necessary records from the subordinate court. These also include some important orders passed by the lower court. For this reason, the court had adjourned the hearing on CBI’s petition till May 4. However, this hearing could not be held even today on the scheduled date.

Justice Swarnakanta Sharma said that the court will call for the relevant records and start the regular hearing of the case from Monday. The court gave clear instructions that all the necessary records should be ordered from the subordinate court by tomorrow, so that there is no hindrance in the further hearing. During the hearing, the court also noted that many parties have filed their replies, but some of the acquitted accused have not yet submitted their replies. On this, the court gave them the last opportunity and asked them to file their answers by Saturday.

The notice has been issued on a plea by an acquitted accused seeking quashing of the interim restraining order granted by the court on April 9. During the hearing, Solicitor General Tushar Mehta, appearing for CBI, told the court that the agency will file its reply on this petition. This case is related to Chief Minister Arvind Kejriwal and other accused, in which hearing is going on on various petitions and objections.
