Terrorist case accused gets 3 days interim bail for attending daughter’s wedding, government will also bear the expenses

Delhi High Court, while giving an important decision on humanitarian grounds, has granted conditional interim bail of 3 days to Habib ur Rehman, accused in the case registered under the Unlawful Activities (Prevention) Act (UAPA). The court has given this relief to attend his daughter’s wedding, which is to be organized on May 31 in Mumbai. The court said in its order that the appellant has been in judicial custody for the last almost 8 years and is not in a position to bear the expenses related to custody parole. In such a situation, the court directed the state government to bear the expenses of his travel and necessary arrangements. The court also made it clear that security arrangements will be ensured during the period of interim bail.

During the hearing of the case, the division bench of Justices Pratibha M. Singh and Madhu Jain passed this order after considering the facts and circumstances of the case. The court held that the accused wanted to attend the marriage ceremony of his daughter and on humanitarian grounds he could be granted relief for a limited period. Habib Ur Rehman is an accused in a case registered by NIA in the year 2017 and has been in custody for a long time. However, the court has also imposed strict conditions along with custodial parole. According to the order, Habib ur Rehman will be allowed only to his house and the wedding venue. Apart from this he will not be able to go to any other place.

2 policemen will stay together during the parole period

In its order, the Court directed the Jail Superintendent to send two police officers with the accused during the entire period of custodial parole. The court clarified that since it was the occasion of his daughter’s marriage, both the policemen would be with him in plain clothes and would monitor him the entire time. It will be mandatory for him to follow all the conditions related to security and monitoring. In the order issued on May 29, the court said that the appellant’s daughter is about to get married, therefore, she is granted custody parole for the period from May 30, 2026 to June 1, 2026, so that she can attend the marriage ceremony held in Mumbai. The court also directed that after the expiry of the custodial parole period, the accused should be brought back to Delhi and handed over to the custody of the concerned jail authorities.

Hearing on regular bail petition will be held on July 6

Advocate Arif Khan, on behalf of Habib ur Rehman, had sought interim bail of 30 days citing his daughter’s marriage. During the hearing, a question arose whether the interim bail application can be considered when the regular bail petition is already pending. On this, the defense argued that the High Court has approved the custodial parole using its inherent judicial powers. The case pertains to the order which was passed by the special NIA court on November 12, 2025. The special court had rejected the bail plea of ​​Habib Ur Rehman, against which he has filed an appeal in the High Court. Delhi High Court has fixed July 6 for the next hearing on his regular bail plea. Even before this, the lower court had rejected his bail plea.
