Ban on election advertising in Delhi Metro continues: Delhi High Court refuses to lift the ban, declares EC’s decision correct

Election advertisements Ban in Delhi Metro: The ban on election advertisements will continue in Delhi Metro. Delhi High Court has upheld the ban on political advertisements in Delhi Metro during elections. The Delhi High Court, while upholding the decision of the Election Commission, said that such steps are necessary to ensure fair elections. After this decision of the Delhi High Court, it has been a big blow to the memorandum agencies, which had approached the court against this order.

Delhi High Court said that Metro is directly connected to the government system. In such a situation, to keep the elections fair, political campaigning cannot be allowed here.

In fact, the Election Commission had banned election advertisements in Delhi Metro during the Model Code of Conduct in Delhi Assembly elections. This decision was challenged by the advertising agencies in the Delhi High Court. The agencies argued that this ban is a violation of their fundamental rights. However, the division bench of the High Court rejected these arguments outright. The court bluntly said that the interest of the general public and fairness of elections is more important than the profits of any agency.

There is a big difference between bus stand and metro

During the hearing, the advertising agencies had argued that when political advertisements can be run at the bus stand, why not in the metro? On this the High Court made the situation very clear. The court said that the metro is directly linked to the identity and system of the government. It cannot be compared to other roadside public places or bus stands. Delhi Metro Rail Corporation (DMRC) also clarified in the court that being a government entity, they are completely bound to follow the rules of the Election Commission. The Election Commission strongly defended its move in the court. The Commission said that this ban has been imposed so that all political parties can get a level playing field at the time of elections.
