Jail for 1 year without trial! BJP government of Bengal is bringing new ‘Gunda Bill’, criminals will tremble

West Bengal Public Safety Gunda Bill 2026: The newly formed Bharatiya Janata Party (BJP) government of West Bengal is going to take a big step to completely strengthen the law and order situation in the state and crack down on criminals. The government led by Chief Minister Shubhendu Adhikari is going to bring ‘The West Bengal Public Safety and Control of Anti-Social Activities Bill 2026’ in the state.

The gazette notification of this very stringent law has also been officially issued. It is believed in political circles that it can be presented on the table of the Assembly during the budget session on Monday. This new bill is also being called ‘Gunda Control Bill’ or ‘Gunda Bill’ in common parlance. CM Shubhendu Adhikari has already made it clear from public forums that eliminating hooliganism and mafia rule from the state is the first priority of his government.

There will be strict control on goons in West Bengal, the scope of law will increase

The state government clearly believes that the existing laws in West Bengal are not sufficient to effectively deal with anti-social elements and goons. This often poses a serious threat to public safety. But the scope of this new law being brought by the government will be very big and strict, which will create real fear of the law among the criminals.

Under this new bill, not only assault or intimidation, but also serious crimes related to illegal mining, extracting stones from mountains, illegal sand extraction from rivers and wildlife trafficking have been included. The government has also fixed the legal definition of the word ‘Gunda’. Under this, if a person is a habitual criminal, continuously does anti-social activities or promotes crime in the society, then he will be directly considered a goon. Old and history-sheeter criminals will also be kept in this strict category.

Police will get ‘super powers’, possible detention for 1 year without trial

This new Public Safety Bill being brought by the West Bengal Government will provide unlimited and special powers to the police. According to the new rules, any suspect can be immediately detained on the basis of a confidential report by any senior police officer of SP rank or above, or at the government’s own discretion.

The biggest and special thing about this entire bill is that if the government or the police have a strong suspicion that a person can prove to be a major threat to public safety and peace of the society, then he can be kept in jail in preventive detention for one year without any court case (trial). The government can fully authorize the District Magistrate (DM) or Police Commissioner to use this strict power in specially notified areas.

Not only this, the police will also have the right to directly confiscate the illegally acquired property of goons and mafias found involved in organized crime. This will include serious activities like illegal mining, possession of illegal weapons, drug smuggling and deliberate damage to government property. The relevant sections of the Indian Justice Code (BNS) will be made the main legal basis for implementing such strict action against criminals.

District transfer action will be taken directly against criminals

In this new bill, a strict provision has also been made for the action of ‘district change’ (Tadipar) to break the morale of criminals and anti-social elements. Under this, the District Magistrate, Collector, Police Commissioner or senior police officers will have the special power that any vicious criminal who is arrested under the ambit of this law, should be shown the way out of a particular district or fixed area for a period of at least one year.

During the entire one year period of this district change, that criminal will not be able to even set foot within the limits of that district. Besides, he will also have to mark his presence before the local police from time to time. If he violates these rules, additional legal action will be taken against him. At the same time, if any accused absconds or hides himself due to fear of this action of the police, then he will have to serve a jail sentence of up to 2 years through the court and will also have to pay a heavy fine.

The rights of the detained person have also been taken into account

However, to prevent misuse of the law and protect the fundamental rights of the detained person, the government has also added some necessary protective provisions in the Bill. Under this, the person who will be detained will be compulsorily handed over a copy of the order of detention and the main grounds for detention within a maximum of five days.

Of course, in some very sensitive cases, the government or the police can completely prevent this information from being made public, provided that revealing it would reveal confidential sources (informers) of the police, or there is a risk that the information coming out would have a negative impact on the law and order of the state, public confidence, internal security or the national security of the country.

This historic bill may be presented in the Assembly on Monday

According to solid reports coming from the political circles of West Bengal, this much talked about ‘Public Safety Bill’ can be presented on the floor of the House for discussion and passing during the ongoing budget session of the Assembly on Monday. Let us tell you that in the recent assembly elections of West Bengal, BJP had included this stringent law as a major promise in its election manifesto. Since Chief Minister Shubhendu Adhikari himself is handling the important responsibility of the Home Ministry of the state, this first law being brought by him as the Home Minister is being considered very important for the entire political and administrative system of the state.
