BJP MLA Karnail Singh’s troubles increased, court sent notice in defamation case on Satyendar Jain’s complaint

Special Judge Jitendra Singh of Rouse Avenue Court has issued notice to Satyendar Jain on the revision petition filed by BJP MLA Karnail Singh in a defamation case. This petition has been filed by Karnail Singh to challenge the order in which the trial court had taken cognizance of the case. The petitioner says that this decision of the lower court is wrong and it should be cancelled. Considering the seriousness of the case, the court has also summoned the complete records of the trial court. The next hearing in this case has been scheduled for July 28.

Old interview becomes cause of controversy in defamation case

This case is related to a TV interview given last year, which has now taken legal form. According to the information, Rouse Avenue Court had taken cognizance of the defamation complaint filed against Karnail Singh on May 29. It has been alleged in the complaint that Karnail Singh had given objectionable and defamatory statements against Satyendar Jain in an interview given to a news channel on January 19, 2025. Taking cognizance, the court had held that there were sufficient grounds to proceed further in the case. After this, the court had directed Karnail Singh to appear on June 6. Now the decision to take cognizance in this matter has been challenged by the BJP MLA, on which the court has fixed the next hearing for July 28. Besides, the complete records of the trial court have also been summoned, so that a detailed review of the case can be done.

Question on negligence in giving statement

The court had held that since both the parties were contesting from the same constituency, they should have exercised more caution and responsibility while making statements against each other. The court had said in its order that the accused first gave the statement to the media and later requested the media persons to exercise caution before publishing it. This raises questions on the credibility and intention of the statement. Additional Chief Judicial Magistrate (ACJM) Paras Dalal, in his May 29 order, had also said that the accused did not make an effort to independently verify the facts before giving the interview. According to the court, the claims made in the complaint are not corroborated by any ED statement, press release or public record.

The court said that it appeared that the accused had given the statement based on his own facts and figures, although this would be confirmed during the trial. The court also made it clear that in this case the mental state (mens rea) of the accused will also be a subject of trial. Along with this, it will also be seen whether the statement in question falls under any legal exception to criminal defamation or not. In the case, the lower court had earlier taken cognizance of the complaint, which was challenged by BJP MLA Karnail Singh in the Sessions Court. After hearing the revision petition, the Sessions Court had canceled the order of taking cognizance on April 30.

Jain made serious allegations in defamation case

Aam Aadmi Party leader and former minister Satyendra Jain has filed a defamation complaint against BJP MLA Karnail Singh. It has been alleged in the complaint that during an interview given to a news channel on January 19, 2025, false and defamatory statements were made against him. According to the complaint, Karnail Singh had claimed that the Enforcement Directorate (ED) had recovered 37 kg of gold from Jain’s house and he had 1100 acres of land in his name. Apart from this, it was also said that Jain has allegedly acquired wealth through corruption, which is a misuse of public money. The complaint also mentions that the accused called Jain a “land mafia” and claimed that he would “go to jail again”. Jain alleges that all these statements are factual, misleading and damaging to his image. A defamation case is pending in the court regarding these allegations, in which further legal process is going on.
