CJI Surya Kant’s big statement: Special attention needed at judicial level in UAPA cases
New Delhi . Supreme Court Chief Justice Surya Kant has given a big statement amid the delay in the trial of Umar Khalid, Sharjeel Imam and other accused jailed under the Delhi Riots and Unlawful Activities Prevention Act (UAPA).
Chief Justice Surya Kant was speaking at the silver jubilee ceremony of the Indian Institute of Mediation and Conciliation in the capital Delhi on Saturday. During this, Chief Justice Surya Kant expressed his opinion on UAPA as well as delay in the hearing. Without mentioning any specific case or accused, the CJI said that UAPA is a matter that needs attention at the judicial level.
Questions are often raised over the prolongation of cases registered under the Unlawful Activities (Prevention) Act i.e. UAPA in the country. Especially some serious questions have been raised regarding the pending trials in Delhi riots cases and the prisoners not getting bail for a long time. Amidst all this, CJI Surya Kant has said that speedy disposal of such cases is the most effective solution to this dispute.
Increased expectations from special courts
CJI Surya Kant said that an important initiative has been taken towards solving this problem. He said that through the judicial process, the Central Government has been motivated to set up special courts to hear cases related to UAPA, PMLA and Narcotic Drugs and Psychotropic Substances (NDPS) Act.
Bail related disputes will automatically end
He said that the Central Government has agreed in this direction and has started the process of setting up special courts to hear cases under these laws. According to the CJI, if the cases through these courts can be disposed of within a year or as soon as possible, then the long pending incarceration and bail related disputes will automatically end.
