Karkardooma Court of Delhi has given a major verdict in the much talked about case of murder of Intelligence Bureau (IB) officer Ankit Sharma during the North-East Delhi riots of 2020. The court has convicted 5 accused including former Aam Aadmi Party (AAP) councilor Tahir Hussain. On Monday, Additional Sessions Judge Parveen Singh, while giving his verdict in the case, convicted five accused including Tahir Hussain. At the same time, due to lack of evidence, the court acquitted six other accused.

During the trial, the prosecution presented 110 witnesses before the court, out of which the court examined the statements of 91 witnesses and the available evidence in detail. On the basis of these testimonies and evidence the court gave its verdict. This case is related to the murder of IB officer Ankit Sharma during the communal riots in North-East Delhi in February 2020. After investigating this case, the police had filed a charge sheet against many people including Tahir Hussain under murder, rioting, criminal conspiracy and other serious sections.

On which charges was Tahir Hussain convicted?

The court had framed charges in this case on March 17, 2023. After completion of the hearing, the court has convicted Tahir Hussain, Nazim, Qasim, Javed and Anas under several serious sections of the Indian Penal Code (IPC). The court convicted all the accused under section 302 (murder), section 149 (offence in furtherance of unlawful assembly), section 148 (rioting while armed with a deadly weapon), section 147 (rioting), section 188 (disobedience to government order) and section 365 (kidnapping). However, the court acquitted Tahir Hussain of criminal conspiracy charges. That is, on the basis of the available evidence, the court found him guilty on other charges including murder and rioting, but did not prove him guilty on the charge of criminal conspiracy.

After the court’s verdict was announced, Tahir Hussain became emotional and cried in the court. Declaring himself innocent, he told the court, “I am innocent, justice has not been done to me.” The court will now issue separate orders on the punishment of the convicted accused after hearing arguments from both sides. That is, at present the court has decided the guilt, while the decision on the punishment period will be given later. At the same time, due to lack of evidence, the court acquitted six other accused Muntajir alias Musa, Shoaib Alam, Haseen, Sameer, Gulfam and Firoz of all charges. The court said that there was not enough evidence available to convict him.

Ankit Sharma’s body was found in the drain, 648 page charge sheet was filed

This case dates back to 25 February 2020, when Intelligence Bureau (IB) security assistant Ankit Sharma was murdered during protests against the Citizenship Amendment Act (CAA) in Chand Bagh area of ​​north-east Delhi. His body was recovered from a nearby drain the next day. After the incident, an FIR was registered in Dayalpur police station on the complaint of Ankit Sharma’s father Ravindra Kumar. The investigation of the case was later handed over to the Crime Branch of Delhi Police. During the investigation, the Crime Branch identified and arrested 11 accused, including the then Aam Aadmi Party (AAP) councilor Tahir Hussain. The police had filed a 648-page main charge sheet in the court on June 3, 2020. After this, during the investigation, six supplementary charge sheets were also presented in the court.

Delhi Police Commissioner Satish Golchha, who led the investigation as Special Commissioner of Police during the 2020 Delhi riots, reacting to the court’s decision said that the police’s first priority was to maintain law and order and ensure a fair, non-discriminatory and evidence-based investigation. He said, “Our first responsibility during the Delhi riots was to maintain law and order and conduct an impartial, non-discriminatory and evidence-based investigation. Every effort was made to gather credible evidence and bring those responsible before the law.”

Satish Golchha further said that the court’s decision has recognized the hard work and professional working style of the investigation team in the judicial investigation. According to him, “We are satisfied with the court’s decision that the hard work and professionalism of the investigation team has stood the judicial test. We are committed to bringing all those responsible for the crimes committed during the 2020 riots to justice and punishing them as per the legal process.”
