During the hearing, California Deputy Attorney General Megan O’Neil made several serious allegations against Meta in front of the jury. It was argued on behalf of the states that the responsibility for the safety of children cannot rest only with the parents. Social media companies should also take care of the safety of underage users on their platforms. It is alleged that Meta gave more importance to its business and earnings rather than the safety of children.

According to the lawyers of the states, some internal documents and emails of Meta will also be presented in the court during the hearing of the case. An attempt is being made through these documents to show that the company was aware of the behavior of teenage users and the impact of Instagram.

One document mentions positive comments about teenagers, while another says that many young people stay connected to Instagram even if they do not feel good after using the app. The states claim that the company prioritized its business interests despite being aware of the potential addiction and other risks.

Accused of collecting data of children

In the 233-page complaint filed in the year 2023, serious allegations were also made against Meta regarding the data of children. States say the company collected information from children under the age of 13 without their parents’ permission. It was alleged that this activity may be against several federal and state laws. The states also say that Meta was aware of features considered harmful to children, but the company did not take adequate steps to remove or change them. If the allegations are proven in court, Meta could be fined up to $200 billion.

Meta denied the allegations

Meta has rejected all the allegations of the states. Company lawyer Paul Schmidt said in court that state lawyers are selectively presenting parts of internal documents and emails. Meta says that it is important to understand these documents in full context and they should not be used against the company on the basis of individual parts.

If the court rules in favor of the states, its impact will not be limited to potential fines alone. Meta may have to make major changes in many features related to children and teenagers on Instagram and Facebook.
