The Supreme Court has expressed strong displeasure over the action of the Executive Magistrate of Noida in the case related to the students' protest at Jantar Mantar. The court expressed its objection to issuing notice to a second year student and reprimanded the magistrate.
During the hearing, a lawyer raised this issue before the court. The lawyer said that despite the Supreme Court barring any punitive action against the students, the executive magistrate issued a notice to a student. On this, the bench headed by Chief Justice Surya Kant expressed strong displeasure over the action of the magistrate. The court termed issuing the notice despite the order of the Supreme Court as contempt of court.
'How dare you issue a notice?'
During the hearing, CJI Surya Kant raised questions on the action of the magistrate in a strict tone. He said, “We are extremely surprised that despite our clear orders that no action would be taken against any student, how did a magistrate dare to issue a notice?” At the same time, the lawyer told the court that a kind of experiment is being conducted on the students of the country. He said that this is direct contempt of court. The administration cannot create an atmosphere of fear among the students by taking such action.
Do not trust newspaper reports, bring facts on record
During the hearing, CJI Surya Kant asked whether any official information had been received regarding withdrawal of the notice. On this, the lawyer said that it was only through media reports that information was received that the notice has been withdrawn after the news came to light. On this the CJI said that the Supreme Court order had banned action against the students without any doubt. “If the administration has taken any action, we can issue them a show cause notice,” he said.
Instructions to bring all documents and evidence on record
Justice Bagchi, who was part of the bench, directed the counsel that if notice has been issued to the student, all factual documents and evidence related to it should be produced on official record. Apart from this, the Supreme Court said that it will seek answers from the District Magistrate of Noida in this matter and clarification will be taken from him on the entire matter. The court clarified that the facts related to the issue of notice should be brought out through official records.
