Kalpana Mishra has got bail from the court in the case registered on the complaint of Uttarakhand Cabinet Minister Rekha Arya. The court gave this decision after looking at the arguments of both the parties and the case diary.
Tezzbuzz Desk- Kalpana Mishra alias Kalpana Chaturvedi, accused in the famous fraud case related to Girdhari Lal Sahu, husband of Uttarakhand Cabinet Minister Rekha Arya, has got bail. The court of Bareilly Additional District and Sessions Judge (ADJ-8) Ashok Kumar Yadav ordered his release on a personal bond of Rs 50,000.
This case was registered on the complaint of Minister Rekha Arya. In the complaint, Kalpana was accused of allegedly misusing the name and address of the minister and her husband, forgery, theft and extortion. Kalpana was sent to judicial custody on 14 July 2026.
What were the allegations in the minister's complaint?
It was alleged on behalf of Rekha Arya that Kalpana Mishra used the name and address of her Bareilly residence of her husband Girdhari Lal Sahu in her Aadhar card, passport and other documents. According to the complaint, Kalpana used the name and position of the minister to influence people and allegedly extorted money.
The minister had also alleged that the Hyundai Creta car that Kalpana was driving had Uttarakhand government boards, hooters and blue-red lights on it. In the case, a demand was also made to investigate the activities of Kalpana and her alleged uncle Dr. RC Pandey.
Allegation of theft of seven lakh rupees and gold garland
The complaint also included allegations of theft of Rs 7 lakh and a gold-studded Rudraksh necklace from a residence in Bareilly. In this case, a case was registered at Baradari police station on 9 September 2024. After the first investigation, the final report was filed in the case, but later the investigation was conducted again after lobbying.
After this, Kalpana Mishra was sent to jail on 14 July 2026. An application was filed in the court on his behalf for bail.
What argument did the defense side give?
Kalpana Mishra's lawyer Lovelesh Pathak told the court that Girdhari Lal Sahu had appointed Kalpana as a manager in his business. For this, a registered contract letter dated July 6, 2022 was also presented. According to the defense, he was given a job at a monthly salary of Rs 25,000.
The lawyer alleged that Kalpana was mentally, physically and financially exploited during her job. His personal money was also confiscated. When he talked about complaining, influence was used to implicate him in the case.
Minister's side opposed bail
Opposing the bail on behalf of the Minister, it was said that Kalpana had used the address of Rekha Arya's Bareilly residence in three different deeds. Transactions worth Rs 10.50 lakh, Rs 12 lakh and Rs 19 lakh were said to be mentioned in these documents.
The prosecution also expressed apprehension before the court that after getting bail, the accused might influence the evidence and witnesses.
Court's comment on documents and case status
The court perused the case diary and the arguments of both the sides. A registered contract related to Kalpana being the manager of Girdhari Lal Sahu was also presented before the court.
The court held that the address in Aadhaar card can be changed, while documents like passport undergo the process of police verification. There was no clear mention in the available records proving the documents to be fake.
The Court also took into account that the case was triable by the Magistrate Court and no report regarding Kalpana's prior conviction was produced. Considering these circumstances, the court approved the bail.
Along with bail, Kalpana has been directed to cooperate in the hearing and abide by the conditions of not influencing the evidence or witnesses.
Girdhari Lal Sahu's name has been in discussion before also.
The name of Minister Rekha Arya's husband Girdhari Lal Sahu alias Girdhari Pappu has also been linked to the famous Jain massacre of Bareilly. He has been an accused in this case. In this case, the allegation of file missing from the court also came to light, after which the file was prepared again on the orders of the High Court.
