Birth and Death Registration Rules: The provisions of the new law making the rules for late registration of births and deaths stricter will come into effect from October 1. Registrar General of India Mrityunjay Kumar Narayan has given information about this on Wednesday. The 'Birth and Death Registration (Amendment) Bill, 2026' passed by both the Houses of Parliament after getting the President's approval last month has become a law.

“In exercise of the powers conferred by sub-section (2) of section 1 of the Births and Deaths Registration (Amendment) Act, 2026 (12 of 2026), the Central Government hereby appoints October 1, 2026, as the date on which the provisions of this Act shall come into force,” Registrar General of India Mrityunjay Kumar Narayan said in a Gazette notification. The law tightens rules on late registration of births and deaths and requires judicial intervention for applications filed two years after the event.
The new law amended Section 13(3) of the Registration of Births and Deaths Act, 1969 (as amended in 2023) to “make the provisions for late registration more stringent”. This bill said, “This will promote timely reporting of events of birth and death.” According to the new law, applications seeking registration after one year but within two years of birth or death will still need an order from the DM, SDM or authorized executive magistrate.
The bill also states that after payment of the prescribed fee, before the registration process can proceed further, the officer will have to verify the genuineness of the incident. This law imposes a strict rule of judicial inquiry for reports made after two years, requiring the order of a Judicial Magistrate (First Class). The Registration of Births and Deaths Act, 1969 was enacted to regulate the registration of births and deaths and matters connected therewith.

Registration of births and deaths is mandatory under this Act, and a certificate issued under the law provides legal identity. Birth or death certificate is valid as evidence to prove the birth or death of a person. The Act was amended in 2023, and the provisions of the amended law came into force from October 1 that year. The government said the amendments are aimed at “promoting timely reporting” of critical incidents.
