The Delhi High Court on Friday took a strict stand regarding the Delhi University Students Union (DUSU) elections. Taking serious note of the alleged violation of rules during the elections, the court has sought answers from the candidates and student organizations. The court has also made it clear that no victory procession of any kind will be taken out after the election results are declared.
Notice issued to candidates
A bench of Chief Justice Devendra Kumar Upadhyay and Justice Tejas Karia has issued notices to student organizations and candidates asking why collective election damages should not be imposed against them for violation of election rules. The court said that even during the last elections, cases of violation of rules had come to light and such a situation cannot be repeated again and again.

During the hearing, issues like convoys of vehicles, vehicles without number plates and alleged display of weapons during campaigning before the court came up. The police told the court that challans have been issued in respect of violations, vehicles have been seized and in some cases FIRs and arrests have also been made.

The court gave clear instructions especially regarding the victory procession. After the declaration of results, candidates, students or their supporters will not be able to take out victory processions in the university campus and hostels apart from on the roads. Delhi Police has been given the responsibility to ensure compliance with this order. The court also said that in case of violation of the order, criminal and administrative action can be taken as well as contempt of court action.

The court also said that the police should not have any hesitation in taking action merely on the basis of being a student. According to the court, all candidates and organizations will have to follow the rules related to elections.
Why election compensation should not be imposed
Now student organizations and candidates will have to respond to the court notice. The petitioner party has been asked to provide documents and other materials related to the alleged violations within two weeks. After this, the parties concerned will be asked why election damages should not be imposed against them.
After this order of Delhi High Court, the situation has become clear regarding the celebrations after the results of DUSU elections. After the results, there will be a ban on victory processions on roads, campuses and hostels and Delhi Police has been instructed to enforce it.
