Supreme Court strict: No trust in AI-generated facts without investigation, ‘zero tolerance’ in decisions

New Delhi. The Supreme Court has said that courts should adopt a policy of zero tolerance on use of AI (Artificial Intelligence) without verification. A vacation bench headed by Justice PS Narasimha made these remarks while setting aside the decisions of the National Company Law Tribunal and the National Company Law Appellate Tribunal in the bankruptcy case of Essel Infraprojects. The Supreme Court found that the National Company Law Tribunal gave its decision on the basis of fake facts based on AI.

The court said that while taking any decision, the courts should verify it by referring to the previous decisions obtained through AI. Zero tolerance policy should be adopted on AI based decisions without verification. The court also said that if a lawyer cites an AI-based decision without verification, it would be considered a malpractice.

The court directed the Bar Council of India (BCI) to form a committee to investigate this aspect. The court said that if any decision is given on the basis of fake AI facts then it will not be considered as a decision in the eyes of law. Such decisions will have to be repealed. If false AI facts are included in the decision making process, then those decisions will have to be cancelled.
