Himachal: Big decision, employees posted in difficult areas will not be transferred without completing their tenure.
Shimla. The Sukhu government of Himachal Pradesh has made a major change in the system related to transfers of government employees. The government has made it clear that officers and employees posted in difficult, tribal, hard and extremely inaccessible areas will now not be able to leave without completing the prescribed tenure.
The Department of Personnel has implemented the new system by amending para 16.1 of the Comprehensive Guiding Principles-2013 (CGP-2013). The government says that many ambiguities were emerging in the implementation of the old provisions.
There was also confusion regarding the provision of option of five preferred places of employees, whereas transfers are done keeping in mind the administrative necessity and larger public interest. For this reason the government has made the rules more clear.
Three years will mean two winters and three summers, vacation time will not be added.
According to the revised rules, the normal tenure in difficult, tribal, hard and extremely inaccessible areas will be three years. For the first time, the Government has said in clear words that three years would actually mean two winters and three summers in that area.
If an officer or employee goes on long leave or remains absent from duty for any reason for a long period, that period will not be added to the tenure.
After returning, the employee will have to serve the same additional period in the same area. The government says many employees try to avoid deployment in difficult areas or stay away from duty for long periods on medical leave and other reasons.
This affects health, education and other essential government services. Kinnaur, Lahaul-Spiti, Pangi area of Chamba and remote areas of Chamba, Kullu, Shimla, Mandi and Sirmaur have been facing the problem of shortage of staff for a long time, as many posts remain vacant or employees remain absent from their place of posting for a long time.
You will not get the benefit of additional workload, only regular deployment will be considered as service.
The government has also clarified the position regarding officers holding additional charge.
If an officer is holding only additional charge in a difficult, tribal, hard or extremely remote area and does not have regular appointment or posting there, then that period will not be treated as service rendered in that area.
Such period will not be included in the prescribed tenure. On this basis, no officer or employee will be entitled to any concession, preference, incentive or any other benefit under the transfer policy.
Relief to those above 55 years of age, no exemption in matters of promotion
In the revised policy, relief has also been given to officers and employees above 55 years of age. The government has said that as far as possible, officers and employees above 55 years of age will not be deployed in difficult, tribal, hard and highly inaccessible areas.
However, this relaxation will not be applicable in cases of promotion and this provision will not be effective on posting due to promotion.
In the office memorandum issued by the Personnel Department, all departments, boards, corporations and other concerned institutions have been informed about the revised provisions and instructed to ensure their strict compliance.
