What did the court say?

The court noted that Ranka and Das, who are in Tihar jail, are likely to commit crimes again as they violated the promises made on October 11. On the other hand, according to Delhi Police, Sourav Das and Ashutosh Ranka repeatedly used social media to call for protests at places like Jantar Mantar and Connaught Place. The police claimed that these places were not fixed for protests.

The two leaders were given permission by the police for the protest on an assurance of strict adherence to the conditions. However, they did not comply with these conditions, the court said in the order.

The reasons adduced by the Investigating Officer show that the conduct of the accused was not proper. Also, the court also said that there is disrespect for the law and a tendency to call for agitation where agitation is not allowed.

Observed threat to peace and public order

The court also observed that there was serious possibility of breach of peace and disturbance of public order due to this case. Therefore, the court clarified that it is necessary to look at this matter seriously. In the background of all these developments, Special Executive Magistrate Ritu Raj has ordered to increase the judicial custody of both the leaders. At this time he considered the previous conduct of the accused and the potential danger they could pose.

Meanwhile, the court also said that the sureties submitted by the defense lawyers are not eligible for bail. The court observed that there was a clear discrepancy between the photograph on the bail bond and the photograph on the Aadhaar card. Therefore, the court rejected the bail application of both the accused and increased their judicial custody.
