Advertisements promoting content related to sexual exploitation of children running on Instagram in India, Azad Adhikar Sena demands action from the government

Child pornography content on Instagram: A sensational case of advertisements promoting content related to sexual exploitation of children has come to light on Instagram in India. Raising this issue, former IPS officer Amitabh Thakur’s party Azad Adhikar Sena has sent a letter to the Cabinet Secretary of the Government of India demanding a high-level inter-agency inquiry into the alleged promotion and dissemination of Child Sexual Abuse Material (CSAM) through Instagram in India.

Azad Adhikar Sena, in its letter, has demanded that an investigation be conducted into serving advertisements on Instagram that allegedly promoted Child Sexual Abuse Material (CSAM) and directed users to external platforms where such content was being made available. Along with this, it has been said that if these allegations are found true in the investigation, then they are serious cognizable offenses under the POCSO Act, 2012, Information Technology Act, 2000 (especially Section 67B), Indian Justice Code, 2023 and other applicable laws.

In the representation, the Central Government has been requested to immediately secure all related digital evidence, identify all responsible persons and entities, investigate the compliance of legal responsibilities of the concerned intermediary and its officers and ensure appropriate criminal, regulatory and administrative action wherever violation of law is found.

Copies of this representation have also been sent to the Principal Secretary to the Prime Minister, Union Home Secretary, Ministry of Electronics and Information Technology (MeitY), Indian Cyber ​​Crime Coordination Center (I4C), CERT-In, National Commission for Protection of Child Rights (NCPCR), Central Bureau of Investigation (CBI), National Crime Records Bureau (NCRB), National Human Rights Commission (NHRC), National Commission for Women (NCW) and senior officials of Uttar Pradesh Police.

In fact, an investigation by BBC-I has found that Instagram is running such advertisements in India for money, through which the content of sexual exploitation of children is being spread. The advertisements, seen by the BBC World Service, used terms such as ‘rape video’ and ‘child video’. Users have been given links to the channels of messaging app Telegram. Here they can buy these materials for just Rs 99.

Advertisements are published on Instagram only when its moderation technology approves them. When a media organization reported such an advertisement to Instagram, the social media company responded after 24 hours that these posts do not violate their ‘Community Guidelines’. Later, when Instagram’s parent company Meta was asked for a response, they said that they have already disabled many advertisements and suspended the accounts posting them. The company said that after investigating the media organization, they have removed more advertisements and disabled the accounts.
