According to sources, Raghav Chadha has decided to leave AAP and join BJP. Along with him, many other Rajya Sabha MPs of AAP may also leave the party and join BJP. What does the anti-defection law say?

Anti-Defection Law in India was implemented under the 52nd Amendment of the Constitution (1985). Its main objective is to prevent political instability and curb horse-trading of MLAs and MPs.

According to this law:

  • If an MP or MLA leaves his party, his membership may be cancelled.
  • But if any party At least two-thirds of the members join the other party simultaneouslythen it is not considered a defection but a “merger”.
  • In such cases the membership of the members does not cease.

Will Raghav Chaddha lose his membership?

If indeed two-thirds of AAP’s Rajya Sabha MPs simultaneously join the BJP, it will be considered a “party merger” under the law. In such a situation, the membership of all the MPs including Raghav Chadha can remain safe.
