Big twist in Adani case! Senior US lawyer said

New York: A very important and positive legal analysis has emerged regarding the ongoing US criminal case against Indian billionaire Gautam Adani. According to Chris Mann, a senior US lawyer in the federal criminal practice, it is only a normal procedural requirement for the prosecutor to ask for more information before a New York federal judge dismisses the case. This order does not at all mean that this case against Adani will move forward or that his crisis continues.

What is Federal Rule 48(a) and the role of the judge?

Senior lawyer Chris Mann clarified that under Rule 48(a) of the US law, whenever the Department of Justice (DoJ) decides to quash the charge sheet or charges filed in a case, it has to seek formal permission from the court.

Under this process, the judge may ask questions to set the record straight or seek additional clarification before rendering his decision. Chris Mann said, “This in itself is not strange. There is no new example in American judicial history where a judge has forced the Department of Justice to prosecute a case that the government (executive branch) itself has dropped.” Because prosecuting criminal cases is constitutionally a function of the executive, American courts have historically given full respect to prosecutors’ decisions.

Why did the US government’s case weaken?

According to documents submitted by Adani to the court on June 24, 2026, and analysis by legal experts, the Department of Justice (DoJ)’s decision to close the case comes after an extremely thorough and detailed review. This entire matter was outside American jurisdiction. All transactions and the bond offerings were conducted under English law between non-US institutions, which are not subject to US securities laws. Testimony from a former senior Indian regulatory official proved that what were alleged to be ‘illegal payments’ were actually legal and transparent ‘commercial discounts’ (price reductions) given to Indian government companies. The original charge sheet makes no mention or allegation of investors losing money in any of the four major transactions. The 2021 bond has been repaid with interest.

The matter may end in weeks

US District Judge Nicholas Garaufis of Brooklyn has given the DoJ until July 13 to respond in detail to its plea. Lawyer Chris Mann believes that the DoJ will submit its detailed report before this deadline and the case will be completely dismissed within a few weeks instead of months. The court can directly approve it without any lengthy hearing.
