CBI On Arvind Kejriwal Affidavit In Supreme Court: The legal debate has intensified regarding the demand for the judge to recuse himself from the hearing in the Delhi Excise Policy case. In this case, the Central Bureau of Investigation (CBI) has strongly opposed the demand of Arvind Kejriwal and other petitioners while filing its written arguments in the Supreme Court.

This controversy is related to the demand of Justice Swarn Kanta Sharma to recuse himself from the hearing in the case related to Delhi Excise Policy. Kejriwal and other petitioners have argued that the judge’s children being associated with a central government panel could lead to conflict of interest.

What is CBI’s logic?

CBI said in its arguments that if the judge is asked to recuse on this basis, it will have far-reaching implications. According to the agency, there are many judges in the country whose relatives are associated with some government panel or the other. CBI says that if Kejriwal’s argument is accepted then all such judges will be ineligible to hear cases which are related to the government or any political person. This will have a serious impact on the judicial system.

Questions raised on judicial process

CBI further said that according to this logic, not only the judges but also the law officers who assign cases to the panel lawyers will be affected. In such a situation, the entire judicial process may be disrupted. The agency, in its written statement, clarified that if such an interpretation is accepted, it could make the functioning of the judiciary impossible and the trial of many cases would be affected.

Objection to social media campaign also

The CBI also alleged in its affidavit that a deliberate social media campaign was being run against Justice Sharma. The agency says that efforts are being made to influence the judicial process through such pressure. CBI also said that the additional affidavit filed by Kejriwal is an attempt to damage the image of reputed institutions and individuals.

danger of setting a bad example

The CBI cautioned the Supreme Court that if Justice Sharma recuses herself from the case, it would set a wrong precedent. Due to this, in future any party can try to remove the judges from the case by putting pressure on the judges through social media or baseless allegations. At present, the final decision in this matter has to be taken by the Supreme Court. All eyes are now on what stance the court takes on this sensitive issue and how it maintains the balance between judicial independence and impartiality.
