Court angry over police negligence in Yuvraj murder case, body identified after 6 days

Saket Court has raised serious questions on the functioning of Gurugram Police in the case of death of real estate businessman Yuvraj Singh Manchanda. The court has taken serious note of the alleged negligence in the process of handling the body, its identification, post-mortem and cremation. The court said that the manner in which the prescribed rules were ignored in the case, the role of police officers and a doctor of civil hospital in destroying the evidence cannot be ruled out.

Questions raised on the process of dead body

The court raised questions on the process from keeping the body safe to its identification and post-mortem. Along with this, seriousness has also been expressed over the alleged irregularities regarding the action related to the last rites. Saket Court has raised questions on the functioning of Gurugram Police and has directed for investigation. The court has ordered an investigation into the case under section 238 of the Indian Justice Code (BNS).

This matter came before the court after petitions filed by Yuvraj Singh Manchanda's sister Harsimran. During the hearing, the court took serious note of the alleged negligence in the process of handling the body, identification, post-mortem and cremation. The court has asked the DCP of Gurugram to send a copy of the order and present the report of the investigation conducted so far in the case before the court. The court also said that it is necessary to investigate the alleged disregard for rules and aspects related to evidence in the case.

Information about dead body posted on ZIPNET after 6 days

In the case of the death of real estate businessman Yuvraj Singh Manchanda, the Saket court has raised serious questions on the functioning of the police of Badshahpur police station. According to the court, Yuvraj's body was found on September 10, but the photo and identification information of the body were uploaded on ZIPNET on September 16. That means this information was posted online about six days after the body was found. The court has considered this delay as serious negligence. According to the court, by the time the photograph and identification information of the dead body were uploaded on ZIPNET, the last rites of the dead body had already taken place. The court said that the initial days after the body was found were extremely important for its identification. The identification process was affected due to a delay of six days in uploading the information.

According to the court, this alleged delay by the police not only affected the investigation, but the family was also deprived of the right to identify their brother's body and cremate it. The court has taken serious note of the alleged lapses in the entire process related to handling of the dead body, identification, post-mortem and cremation.

Yuvraj's body remained in the mortuary for 72 hours, yet no attempt was made to identify him: Court

Saket Court has once again raised serious questions on the functioning of Gurugram Police in the case of death of real estate businessman Yuvraj Singh Manchanda. The court said that Yuvraj's body was kept in the mortuary for about 72 hours, but even during this time his photo and information related to his identity were not uploaded on ZIPNET. ZIPNET is used to identify unidentified dead bodies. The court admitted that the process of identification of the dead body was affected due to the information not being uploaded on time.

The family could not even attend the funeral

The problems faced by the family were also mentioned in the petitions filed by Yuvraj's sister Harsimran. During the hearing, the court said that the complainant allegedly lost her brother in a brutal murder and due to the lapse of the police, she could not even see her brother's body. The family could not even attend the funeral. The court has taken serious note of the alleged negligence in the process related to identification, post-mortem and cremation of the body. The court had earlier also said that the role of police officers and a doctor of the civil hospital in destroying evidence cannot be ruled out due to alleged ignorance of rules.

Missing FIR was already registered in Delhi

During the hearing, the lawyer appearing for Harsimran told that the FIR regarding Yuvraj's disappearance had already been registered in Lajpat Nagar police station of Delhi. Despite this, the body found in Gurugram was considered unidentified and was cremated. This question was also raised by the lawyer before the court as to why the information about the recovered body was not matched with the missing reports lodged in the surrounding areas. He said that if this had been done, it was possible that the body would have been identified in time and the family would have got a chance to attend the last rites.

Court also raised questions on post mortem report

Saket Court has also raised questions on the post mortem report in the case of death of real estate businessman Yuvraj Singh Manchanda. The court raised objections to several points recorded in the report. 'NIL' is recorded in the external injuries column in the report. At the same time, no abnormalities were noted in many internal parts including the neck, head and skull. Despite this the doctor declared the cause of death to be drowning. On the other hand, based on the alleged disclosures of the arrested accused in the Delhi Police investigation, it came to light that Yuvraj was shot twice near the neck. Police have recovered the weapons used in the alleged crime, Yuvraj's mobile and other electronic evidence. In view of these facts, the court said that the available material points towards the possibility that Yuvraj may have died due to gunshot wound and the body was later disposed of to hide the evidence. This is a possibility expressed by the court on the basis of facts revealed during the investigation, not a final conclusion.

Why was X-ray not done to confirm the bullet?

The court also raised questions on the fact that despite the fact that the body was decomposed, why its X-ray was not done. According to the court, if a bullet or any metal piece was present inside the body, X-ray could have provided important information about it. The court said that mere decomposition of the body does not necessarily result in the complete disappearance of the bullet path or projectile marks present in the bone. However, to accurately confirm the bullet injury, the post-mortem had to be conducted as per the prescribed procedure.

Post mortem was not even videographed

In the case of the death of real estate businessman Yuvraj Singh Manchanda, the Saket court has raised questions on another major deficiency in the post-mortem process. According to the court, Yuvraj's post-mortem was not videographed. Apart from this, samples required for viscera and diatom test were also not kept safe. Looking at all these points, the court said that the prescribed rules were not followed in the post-mortem process. The court has ordered Dr. Manav Chauhan, Medical Officer of Civil Hospital, Gurugram, to appear in person. He will have to answer the court's questions regarding the discrepancies revealed in the post-mortem report.

DCP ordered to file status report in two weeks

Saket Court has directed the DCP of Gurugram to file the status report of the investigation conducted in the case within two weeks. The court has also considered it important to investigate the alleged shortcomings in the process related to identification, post-mortem and cremation of the dead body.

Yuvraj went missing on 6th September

According to case records, Yuvraj Singh Manchanda had gone missing on 6 September. After this, on September 11, an FIR regarding his missing was registered in Lajpat Nagar police station of Delhi. Delhi Police had arrested Yuvraj's former colleague Anya Vats and her associate Sanyam Sachdeva from Uttarakhand on September 16 in the case. Now the investigation in the case is not limited to just the reasons for Yuvraj's death. The entire process adopted after the body was found, from handling it to identification, post-mortem and last rites, is also under investigation.

Next hearing will be held on October 15

Saket court has fixed the next hearing of the case on October 15. Gurugram DCP will have to file his status report on that day. At the same time, Medical Officer Dr. Manav Chauhan will also have to personally appear in the court and answer the questions related to the post-mortem report.
