Court’s decision: Woman dies due to firing at New Year party, BJP MLA Raju Kumar Singh found guilty
Delhi’s Rouse Avenue Court, while giving a major verdict in the famous Harsh firing case of 2018, has convicted Bihar BJP MLA Raju Kumar Singh. The court ordered his detention after his conviction. This case is related to the celebratory firing that took place on 31 December 2018 during the New Year party organized at a farmhouse in Vasant Kunj, South Delhi. A woman had died in the incident, after which the police registered a case and started investigation.
The court has convicted Raju Kumar Singh under Section 304 (Part 2) of the Indian Penal Code (IPC) and Section 30 of the Arms Act. Section 304 (Part 2) applies in cases where the accused is aware of the possible fatal consequences of his act, but does not have a clear intention to commit murder. At the same time, the court acquitted two other accused, Rana Rajesh Singh and Ramendra Singh, including co-accused and MLA’s wife Renu Singh in the case, giving the benefit of doubt.
The court said in its decision that firing from a licensed pistol in a crowded environment like a New Year party is an act, the possible fatal consequences of which the accused should have been aware of. The court said that the accused firing into the crowd showed that he had the knowledge that such an action would result in the death of a person. Despite this, weapons were used, which comes under the category of serious negligence.
The accident happened on 31 December 2018
This matter is of the night of 31 December 2018, when a New Year party was organized at the farmhouse of Raju Kumar Singh located in Vasant Kunj. Architect Archana Gupta was seriously injured in the harsh firing that took place during the party. He died during treatment on 3 January 2019. After the incident, Delhi Police arrested Raju Kumar Singh and his associates and registered a case. After a long investigation and hearing, in the year 2023, the court had framed charges against Raju Kumar Singh, his wife Renu Singh and other two accused Rana Rajesh Singh and Ramendra Singh. At that time, the court had prima facie held that a case was made out against Raju Kumar Singh under Section 304 (Part 2) of the Indian Penal Code (IPC) and Section 30 of the Arms Act. In the latest decision, the court convicted him under these sections.
The court said in its decision that sufficient evidence was not found against co-accused Renu Singh, Rana Rajesh Singh and Ramendra Singh. On this basis, all three were acquitted of all charges. The case pertains to a New Year party held on the night of December 31, 2018, where architect Archana Gupta was seriously injured in alleged Harsh firing. He later died during treatment on January 3, 2019. The court held that the use of a weapon in a crowded environment represented grave negligence and the accused should have been aware of its potentially fatal consequences.
