The Delhi High Court on September 30 permitted Tahir Hussain to obtain forensic data and call detail records related to two cases to support his defense in an ongoing matter.
One of the cases pertains to the Ankit Sharma murder. Justice Sanjeev Narula allowed the plea filed on Hussain’s behalf, setting aside a trial court order that had dismissed his petition.
Hussain sought forensic data retrieved from his phone and call detail records registered at Khajuri Khas and Dayal Pur Police Stations from February 2020. The Delhi Police had relied on data from these two cases in another case registered at Khajuri Khas police station.
Advocate Rajiv Mohan, representing Tahir Hussain, submitted that the requested records could prove his client’s innocence. He clarified that Hussain did not intend to rely on this data to present evidence but wished to use it to support his case.
The Delhi Police counsel did not oppose the application following the submissions made by Hussain’s lawyer.
Tahir Hussain was sentenced to life imprisonment in the Ankit Sharma murder case, with his appeal currently pending before the High Court. He is also one of the accused in the larger conspiracy case concerning the 2020 Delhi riots.
