Delhi HC’s big decision: 17-year-old son allowed to donate liver for his father, said- saving life is top priority

In an important and sensitive case, the Delhi High Court has allowed a 17-year-old minor son to donate a part of his liver to his critically ill father. The court made it clear that if organ donation was not allowed in this situation, it could pose a serious threat to the father’s life. The court described this decision as being in accordance with justice, human compassion and right to life.

Court said- Injustice against minor has to be stopped

The High Court said in its order that even though the petitioner is a legal minor, he is physically completely healthy and wants to donate the liver due to his free will, love and deep attachment towards his father. The court held that in such a case, it would not be justified to stop organ donation only on the basis of age.

Father’s critical condition became the basis for the decision

It was told in the petition that the minor’s father is suffering from serious liver disease and is being treated at the Institute of Liver and Biliary Sciences (ILBS) located in Vasant Kunj, Delhi. According to doctors, his life could be in danger if liver transplant is not done on time. For this reason the son approached the court through his mother.

Delhi government and Lieutenant Governor also approved

During the hearing, the Delhi government filed an affidavit in the court saying that the Lieutenant Governor and the concerned competent authorities have given permission for liver transplant after reviewing all the necessary procedures. Taking this official approval on record, the High Court also allowed the transplant.

Can become an important example in organ donation matters

Legal experts believe that this decision could become a precedent for special cases in the future where exceptional circumstances exist such as the voluntariness of the minor donor, medical fitness and the need to save the life of the patient. However, the court also made it clear that each case will be decided on the basis of its facts and medical evaluation.
